Terms and Conditions
1. Services Provided: RealtyQuest Inc.’s Property Management division agrees to provide property management services for the Client's properties in accordance with the terms of this agreement.
2. Scope of Services: RealtyQuest Inc.’s Property Management division will be responsible for tasks such as tenant screening, rent collection, property maintenance and repairs, lease administration, and other related services as agreed upon between the parties.
3. Fees and Compensation: RealtyQuest Inc.’s Property Management division shall be entitled to receive compensation for its services as outlined in the agreement. This may include a percentage of the monthly rent, leasing fees, and other charges as agreed upon.
4. Term of Agreement: This agreement shall remain in effect for an initial term of 12 months and may be renewed or terminated by either party upon written notice.
5. Responsibilities of the Client: The Client agrees to provide accurate and up-to-date information about the property, comply with all applicable laws and regulations, and cooperate with RealtyQuest Inc.’s Property Management division in the performance of its duties.
6. Tenant Selection and Screening: RealtyQuest Inc.’s Property Management division will use its best efforts to find and screen suitable tenants for the Client's properties. However, the final decision on tenant selection shall rest with the Client.
7. Rent Collection: RealtyQuest Inc.’s Property Management division shall collect rent from tenants on behalf of the Client and remit the funds to the Client in a timely manner, less any agreed-upon fees or expenses.
8. Maintenance and Repairs: RealtyQuest Inc.’s Property Management division will coordinate and oversee necessary maintenance and repairs for the Client's properties, subject to the Client's approval for expenses above a certain threshold.
9. Accounting and Reporting: RealtyQuest Inc.’s Property Management division shall maintain accurate records of all financial transactions related to the Client's properties and provide regular reports to the Client.
10. Insurance and Liability: RealtyQuest Inc.’s Property Management division agrees to maintain appropriate insurance coverage for its operations. However, the Client remains responsible for maintaining adequate insurance coverage for the property.
11. Termination: Either party may terminate this agreement upon written notice if the other party fails to fulfill its obligations under this agreement, subject to any applicable cure periods.
RealtyQuest Inc.’s Property Management Division:
Refund Policy
1. Refund Eligibility: RealtyQuest Inc.’s Property Management division aims to provide exceptional services to our clients. If you are not completely satisfied with our services, you may be eligible for a refund under the following circumstances:
a. Early Termination: If the client decides to terminate the agreement with RealtyQuest Inc.’s Property Management division before the agreed-upon term, a refund may be considered based on the remaining unused portion of the prepaid fees, subject to any applicable cancellation fees.
b. Failure to Provide Services: If RealtyQuest Inc.’s Property Management division fails to provide the agreed-upon services due to reasons within our control, and we are unable to rectify the situation to the client's satisfaction, a refund for the affected period may be considered.
2. Refund Process: To request a refund, the client must notify RealtyQuest Inc.’s Property Management division in writing, clearly stating the reason for the refund request and providing any supporting documentation or evidence. The request should be submitted within a reasonable timeframe after the occurrence of the eligible event.
3. Refund Determination: RealtyQuest Inc.’s Property Management division will review the refund request and assess its validity based on the terms and conditions outlined in the agreement between the parties. We reserve the right to request additional information or documentation to support the refund request.
4. Refund Amount: The refund amount will be determined based on the specific circumstances of each case. It may include a prorated portion of the prepaid fees for the unused period or a partial refund for services not rendered.
5. Refund Disbursement: Approved refunds will be processed within a reasonable timeframe and will be disbursed in the same form as the original payment, unless otherwise agreed upon between the parties.
6. Non-Refundable Fees: Certain fees, such as administrative fees, application fees, or fees for additional services, may be non-refundable and will not be eligible for refund under any circumstances.
7. Dispute Resolution: If there is a disagreement regarding the eligibility or amount of a refund, both parties agree to engage in good-faith negotiations to resolve the dispute. If a resolution cannot be reached, the parties may seek mediation or arbitration as outlined in the agreement.
RealtyQuest Inc.’s Property Management Division:
Privacy Policy
At RealtyQuest Inc.’s Property Management division, we are committed to protecting the privacy and confidentiality of our clients' personal information. This privacy policy outlines how we collect, use, disclose, and protect the information we gather from our clients.
1. Collection of Personal Information:
a. We collect personal information from our clients during the initial consultation and throughout the duration of our property management services. This information may include, but is not limited to, names, contact details, property address, financial information, and any other information necessary for providing our services.
2. Use of Personal Information:
a. The personal information we collect is used for the following purposes:
i. Providing property management services, including tenant screening, rent collection, property maintenance, and lease administration.
ii. Communicating with clients regarding property-related matters, updates, and service-related information.
iii. Facilitating financial transactions, such as processing rental payments and refunds.
iv. Complying with legal and regulatory requirements.
3. Disclosure of Personal Information:
a. We may disclose personal information to third parties in the following circumstances:
i. To authorized personnel within our organization who require the information to perform their duties.
ii. To contractors, vendors, or service providers who assist us in delivering our property management services, such as maintenance personnel, accountants, or legal advisors.
iii. When required by law or to comply with legal obligations, such as responding to a court order or government request.
iv. With the client's consent, for specific purposes disclosed at the time of collection.
4. Security of Personal Information:
a. We take reasonable measures to protect the personal information we collect from unauthorized access, use, or disclosure. These measures include physical, technical, and administrative safeguards to maintain the security and confidentiality of the information.
5. Retention of Personal Information:
a. We retain personal information for as long as necessary to fulfill the purposes for which it was collected, as required by law, or as otherwise agreed upon with the client. Once the information is no longer needed, we will securely dispose of or anonymize it.
6. Client Rights:
a. Clients have the right to access, update, and correct their personal information in our records. Requests to exercise these rights should be submitted in writing to our designated privacy contact.
7. Updates to the Privacy Policy:
a. We may update this privacy policy from time to time to reflect changes in our practices, legal requirements, or industry standards. We encourage clients to review the policy periodically for any updates.

RealtyQuest Inc.’s Property Management division:
Cancellation Policy
At RealtyQuest Inc.’s Property Management division, we understand that circumstances may arise where clients need to cancel their property management services. This cancellation policy outlines the guidelines and procedures for cancellations.
1. Cancellation Requests:
a. All cancellation requests must be submitted in writing to RealtyQuest Inc’s Property Management division. This can be done via email or through our designated cancellation request form.
b. The cancellation request should include the client's name, property address, and a brief explanation for the cancellation.
2. Cancellation Fees:
a. Depending on the stage of the property management agreement, cancellation fees may apply.
b. If the cancellation request is made within the initial trial period or before the start of the contract term, no cancellation fees will be charged.
c. If the cancellation request is made after the contract term has started, a cancellation fee will be applied. The amount of the fee will be communicated to the client at the time of cancellation and will depend on the specific circumstances and services provided.
3. Refunds:
a. In the event that a cancellation fee is applicable, any prepaid fees or deposits will be evaluated for refund eligibility.
b. Refunds, if applicable, will be processed within a reasonable timeframe, typically within 30 days of the cancellation request.
4. Property Handover:
a. Upon cancellation, RealtyQuest Inc.’s Property Management division will coordinate with the client to ensure a smooth transition and handover of property management responsibilities.
b. Any necessary documentation, keys, access codes, or other property-related items will be returned to the client promptly.
5. Contract Termination:
a. Cancellation of property management services does not terminate any existing lease agreements or contracts between the client and tenants. It is the client's responsibility to manage any ongoing lease agreements or contracts.
6. Cancellation Policy Changes:
a. RealtyQuest Inc.’s Property Management division reserves the right to modify or update the cancellation policy at any time. Any changes will be communicated to clients through our website or other appropriate channels.
